Hello - I was involved in an auto-accident in March of 2006 in which both insurance companies (mine and hers) agreed that it was the other party's fault and I was a zero-liability. Their insurance company (let's call them Venus , of ease) has asked for receipts ($1000 in rentals which my coverage does not cover), my deductible amount and any other amount which I had to put out (total is about $1,700). I have waited since April for them to pay me. I get letters from Venus every other week saying they are pending further investigation - but, I am at wits-end and want my money which I had to pay-out for an accident that everyone acknowledges is not my fault. Does anyone know what the law/rules are in California and how long they can take to pay after they find the other party is at fault? Why would an insurance company deny me coverage for not having central air and heating?

We wanted to switch from the local company we had been insuring our house with because their correspondance has always been very rude and they are very difficult to deal with to USAA who we do all of our banking, brokerage, car & boat insurance through and are very courteous and extremely easy to deal with. We were denied coverage because our home does not have central air or heating. We live in South Central Florida so a heating system would be an absolute waste of money (the wall unit in the Great Room and a space heater in the bedroom are more than sufficient to make the house hospitable in the few welcome days of winter cold enough to warrant their use). My wife and I both cannot stand Air Conditioning and would never use Central A/C other than the one or two times a year we would normally turn on our wall unit when it is too hot to bear and the windows and doors cannot be left open. Houses have existed for Milleniums prior to the invention of Central Climate Control and I am sure home insurance existed atleast a few decades before the invention of air conditioning. Why would not having central climate control be a disqualifying factor in getting home insurance coverage? I highly doubt that not having A/C or heat is going to make our house any more likely to be damaged or destroyed in a hurricane, robbed or flooded. Opening the windows and doors instead of having a HVAC system consistantly running in our house makes us less suseptable to fire.

Hello, I am a nineteen community college student living in North San Diego, California and I live with my parents. I make less that $1,000 a month working part time and going to school full-time. hi all i was hoping you could get some facts/and or legal advice. Ok so i have been renting this car for about 6 month now because i cant afford a down payment for my own. I had my own car insurance which covered the rental. However(bad luck struck) i got into a car accident 2 days after my car insurance lapsed i have since renewed my policy right away with another insurance company that gave me better rates. The fault of the accident has not yet been determined. I was told by my car insurance that my car was totaled, and would only be good for parts. It was in a MINOR flood, and I called to have it evaluated. They said water was in the motor, fuse boxes, everything was ruined supposedly. I knew they were lying, because I had my fiance check it all out, and there wasn't a drop in it except for the carpeting. I told them so, and said I wanted the car back to fix it myself, but the adjustor said they already paid my bank for the damage (not even the full amount, they came up with about 45% of the payoff amount, but it was worth what I owed on it). They said if I wanted it back, I would have to give them $2,700 for the car. I said to hell with it, and had to come up with 2,600 to pay off the remaining part of the loan, and then go buy another car. Last year, I seen my car in the next town over. Same vin number, same paint chipped bumper, same fist mark behind the passenger door. I was mad, but blew it off. Then, I seen it on a buy sell trade site and decided to inquire about the details. The guy bought it for $800 and didn't have to fix anything on it except for what I needed to fix before the flood (window regulator, wheel baring, and new tires). He told me he thought I had committed insurance fraud to get a pay out from them. So, I called my old insurance company, and the lady took all my information down and gave me the adjustor's number, the adjustor's supervisor's number, and the fraud department's number. I called the adjustor, left a message, and then filed a claim with the fraud department. They said to expect a call from them next week. What exactly happens in a case like this?? I don't expect a hefty payout or anything, but still, I've never known anyone who had this happen to them, but I do know people who committed insurance fraud. They get into huge trouble and pay out fines, but what if its the INSURANCE that commits fraud? Thanks!!

hi, im a 18 year old male looking for a new car, im looking at estates as i surf and need alot of space for boards etc. my last car, a clio 1.5 diesel was super cheap to run and tax (60mpg +) and insurance group 9 so didnt completely bust the bank. im looking at cars like the skoda fabia estate (1.2 and 1.9 Diesel) and the peugeot 307 and 207 1.4 diesels as they are also cheap to run and insure. the problem is i live in devon and any cars that are reasonably cheap are scarce. Car Insurance Claim Help? On the 4/7/2011 I was at a set of traffic lights that was (RED) of my way to the shops. As the lights went green I begin to move off slowly as I did another car came from the left of me and tried to turn right as he speed up he crashed into the drivers side of the car. He clearly jumped a red light (Clearly Seen on CCTV). I was in total shock at the time! After he crashed into my car he went to drive off by reversing, I jumped out of my car to stood in his was so he could not drive off the witness behind me called the police while I was stopping his from driving off he started to drive forwards trying to me me out the way. After the driver spoke to the police on the phone, he then gave me his Name, Phone number and Insurance information. The next day I called my insurance company they was vary helpful and I believe the clam would be settled in my favor as I had CCTV of the crash as I had a camera inside of my car and a witness that was behind my car at the time of the crash. After nearly 4Months I have now revived a letter stating that the claim has been closed on a Without Prejudice Basis. When I contacted Aviva to see what the 3rd party has not accepted full liability they said it was dealt with like this as the 3rd party who crashed into me was not responding to and calls or letters that have send him. Aviva did not asked to see the CCTV of the crash and did not take into account the witness statement. WHAT CAN I DOOO??

Hello everyone, I am really confused and need your help, please. I rented a car from Avis in Calgary, Alberta and drove to Vancouver, BC. I was involved in a collision recently. The other partys insurance company (met life) agreed that it was their clients fault. However, the other party had a witness saying I was speeding which I knew I was not. Okay, first and foremost thanks for reading. The situation with me right now is I'm thinking about cancelling my car insurance after this month. This is my first time having insurance but I can't afford the payments because I have been unsuccessful in getting a job. Not only that but the car cannot be driven again until it is fixed so it will stay in the yard. I didn't get into an accident or anything but it needs a few parts cause they've worn out. So I was just going to get it cancelled/lapsed whatever since there is no point for me to have it if I cannot drive my vehicle. I don't have the money right now to repair it either. I'm thinking about cancelling it, waiting until I get my car fixed and then getting some new insurance. But my mom told me that once your insurance runs out in NC you have to bring the tags back... Does that mean I have to pay the full registration fee again once I get another insurance policy as well? Or can I somehow just keep my tags until I get some new insurance within the next two or three months? By the way the vehicle will stay parked until I have enough money to fix it and insure it.

Totaled a Financed car Liability Insurance!?

Okay December 22 2012 I went to Eldorado Motor to Finance a nice car! I'm 18 had no credit but I held a job since I was 16! Anyways I got Approved! I picked out a Red 2001 Ford Focus! Its was 7, 000 butt after everything was said and done it all added up to like 10, 000! Anyways when I got the car I didn't know they wouldn't let me leave with the car unless I had insurance! So after I gave the $500 Down payment! They was like alright all we need is proof of insurance & sign some paper work and its mine! Well I only had like 600 bucks and 100 left after I gave the down payment...I told them I wouldn't be able to get insurance until next payday cause I was broke! They worked with me and said how much will it cost you for insurance? I told them it depends on if I needed Liability or full coverage! They said all you need is liability! I was in shook! I clarified like twice if I could get Liability? They said yes! So I called State Farm got a 220 quote and Eldorado Motor dropped my down payment to 300 and refunded me 200 So II paid for insurance! And was rolling! Butt I do remember asking what happens if I wreak? They told me they had a repair shop and all I would have to do is pay a 200 dollar deductible! And they would repair it and just tack the rest of the repairs on my car note! So fast forward like 4 months its April 12 2013 I was in a hurry Tailgating a Truck and finally this ttuck in front of me swerved into the next lane! I thought the Truck was getting outta my way so I could go ahead of him turms out he swerved around a turning car! And I couldn't stop in time and I rear ended the car turning!!! So the Truck drives off and I got out checked on everybody no one was hurt! But my car and the guy I hit the cars was Totaled I could tell by just looking at it! Anyways my Liability insurance covered the guy I hit but not me!!! So I called Eldorado Motor and told them everything now i've been without a car 4 a week and don't know what the car lot wants to do

A little over a year ago, I was in a car wreck and due to financial responsibility laws I had to pay for the accident. (I had no insurance, of course, I've learned this lesson) Recently they've filed suit against me for more money that they didn't receive from the insurance company. I can't afford an attorney and was about to hire a bankruptcy lawyer for all of this, but I recently found out from the insurance company that the case is closed. It's also been over a year as of a couple days ago and due to Tennessee's Statute of Limitations they can't claim any more money. So my question, the insurance company says it's closed and even said the attorney settling with them has closed the case. I call the opposing attorney myself and of course they say they can't discuss the case with me, even though I'm just asking if the case still actually exists. They wont' give me a court date either so naturally, I'm a bit suspicious. Should I be ready to put this behind me, or do law offices do this sort of thing all the time? They were recently paid out $10,000 from the insurance company I'm making payments to. I really don't see where else they could find money given my situation. All answers are appreciated, thank you!

I have 3rd party insurance only on my car. Someone went into the back of me & has admitted fault. They asked if they could try to settle without going through insurance companies but they are taking too long to get back to me with an offer to settle. I have been to get some bodywork quotes but have been told that it will probably be an insurance write off. The amount they give me will not enable me to buy the standard of car that I want & I don't want to put any more to it. Can I buy back an insurance write off in Ontario? my 2009 vauxhall insignia was hit from behind sitting at a car park space in a supermarket,there is substantial amount of damage to the right hand arch right above the back wheel,the back bumper is also broken,it was hit that hard it was pushed onto the car park space in front of it,i believe what saved it from any further damage was the driver of the other car hit the wheel of my car which i guess cushioned the blow.i have went today and got estimates for the repair which is in the region of 2500 pounds though could be more as they have to put it on some sort of machine to see if the wheel alignment is of,the repair shops say what they will do is cut the arch out and put a new arch in and spray it but no matter what its never going to be the same.the reason they do it like this is because the whole back of my car runs to the front without any splits. Im not happy about this being done like this as this car today is worth around 10,000 pounds which i pay for and dont want it patched up,i would prefer if the other guys insurance wrote it off so that i can get an original car which i first had,is there anyway i can get this to be wrote of and claim it of the guys insurance,i have heard of depreciation money if my car has been hit but this is still not going to compensate me for my car being patched up. thanks

Now I am looking to get insured on my first car. If I add her to my insurance as a named driver the premium is about 200 less. The problem is she doesn't want me to tell the insurance company that she crashed, as they asked has the named driver crash. I am now worried I were to crash, they would see she had crashed and void the insurance. I am tempted just to get my insurance in my name and pay the extra 200 for peace of mind. She will not under any circumstance tell her insurer she crashed as she thinks her premiums will rise. But I have found out that the insurance companies have a database of all claims, so they can easily find out that she has crashed. She refused to allow me to put on my application for insurance that she has crashed. What to do?
